DEPARTMENTAL AND ORGANIZATIONAL MATTERS
WHEREAS: The election of department chairpersons is a term and condition of employment covered under Article XVIII of the Agreement (the "Agreement") made as of October 2, 1992 by and between the State of New Jersey and the Council of New Jersey State College Locals, NJSFT-AFT, AFL-CIO (the "Union"); and
WHEREAS: The Union is the exclusive representative for the purpose of collection negotiations for all terms and conditions of employment; and
WHEREAS: The Agreement contains no explicit term limits on department chairpersons; and
WHEREAS: The Union has publicly stated that it is the Unions understanding that no term limits on department chairpersons was intended or implied under Article XVIII of the Agreement; and
WHEREAS: The Faculty Affairs/Faculty-Student Concerns Committee after reviewing the Agreement agrees with the position taken by the Union;
NOW, THEREFORE, BE IT RESOLVED BY THE COLLEGE SENATE: That department chairpersons shall be eligible to succeed themselves in accordance with their departments customary and usual election procedures; and
BE IT FURTHER RESOLVED BY THE COLLEGE SENATE: That the Union be requested to review its current policy, giving due regard to those concerns expressed by the faculty and the administration, in connection with its collective negotiations concerning the successor agreement to become effective July 1, 1995.
